Most people focus on the short-term consequences of a drunk driving (DUI or DWI) conviction. As a first time DUI offender, you likely will face minimal jail time (usually 1 or 2 days) and a fine of about $1,000. However, the long-term consequences are even more serious. You face the suspension of your driver’s license for at least 90 days (two years on your second offense), driving with an ignition interlock device placed on your car, as well as paying for high risk insurance (SR-22) for the next three years.  If this is your second or subsequent offense, the short-term consequences can be much more severe.

At the Law Office of Thomas E. Weaver, I understand both the long-term as well as the short-term consequences of a DUI arrest. My goal is to minimize the effect of the arrest on your life now and in the future.

As your DUI lawyer, I will look for technical defenses such as whether the arresting officer had reasonable suspicion to stop you and probable cause to administer a breathalyzer test. My primary goal is to suppress the results of the breathalyzer test if there is a legal basis to do so.

I will also examine the police report for consistency. For example, if you blow a .20 on a breathalyzer test, I would expect you to fail all of your field sobriety tests. I would also expect your driving to show significant impairment. However, if you were pulled over because of a broken tail light, or if you actually passed some of your field sobriety tests, I could use that as evidence that the breathalyzer did not give an accurate reading. As an experienced appellate attorney, I will always look for technical defenses in a way that will benefit your case.
